fa بررسی رازداری پزشکی در فقه و حقوق <p dir="RTL">مسألۀ رازداری یکی از ارکان مهم روابط پزشک و بیمار است و آیات و روایات به صورت عام بر این موضوع دلالت دارند. پزشکان ضمن وظیفۀ اخلاقی و سوگندی که یاد کرده‌اند، موظف هستند شرط ضمن عقد قراردادی را که با مریض یا سازمان مربوطه بسته‌اند، اجرا کنند. همچنین به استناد مادۀ 648 قانون مجازات اسلامی افشای اسرار بیماران جرم است. هدف از پژوهش حاضر، یافتن پاسخ مناسب در خصوص &laquo;ماهیت فقهی و حقوقی رازداری پزشکی&raquo; جهت دفاع از حقوق بیمار بوده، که از طریق روش توصیفی ـ تحلیلی با تکیه بر منابع فقهی و حقوقی صورت پذیرفته است. در نتیجه مطالعات مشخص شد، ممکن است شرایطی پیش آید که پزشک ناگزیر به نقض رازداری شده، ولی باید از ناحیۀ این آشکارسازی کم ترین ضرر متوجه بیمار شود.</p> <p>The subject of Confidentiality is one of the main issues in the relationship between patients&#39; and physicians&#39;; and there are verses in the Koran as well as Hadiths referring to this issue in general. With regard to their ethical duties and the oath they have taken, physicians are obliged to abide by the conditions of the contracts they have signed with the patients&#39; or with related organizations. Moreover, on the strength of article 648 of Islamic penalties law, disclosure of patients&#39; secrets is a crim. The aim of the present research is to find a suitable response, in regard to &quot;the jurisprudential and legal nature of medical confidentiality&quot; in order to defend the patients&#39; rights. The study has been carried out using descriptive - analysis method relying on jurisprudential and legal sources .
