fa بررسی مسؤولیت کیفری مبتلایان به اختلالات روانی <p dir="RTL">یکی از موضوعات مهم در حقوق جزا، بحث مسؤولیت کیفری است و ارتکاب جرم در شرایطی که قابلیت انتساب به مرتکب را داشته باشد موجب استقرار مسؤولیت کیفری و مجازات خواهد شد مگر آن که مجرم به دلایلی قادر به تحمل مسؤولیت جزایی نباشد. گاهی فرد، مرتکب رفتاری مجرمانه می‌شود که بسیاری از این رفتارهای نابهنجار فرد ناشی از اختلالات روانی است که فرد خود به وجود آن در روح و روانش اعتقادی ندارد. فرد تحت تأثیر اختلالاتی که از فرایند آن ناآگاه است مرتکب جرم می‌شود.</p> <p dir="RTL">هدف از این پژوهش این است که با بررسی سیر تقنینی مقررات جزایی و تبیین آثار برخی از بیماری‌های شدید روانی در حین ارتکاب جرم، به بررسی تحمیل مسؤولیت کیفری بر بیماران روانی بپردازیم.</p> <p>Criminal responsibility&nbsp; has always been a subject of debate in the field of criminal law since committing an offence ,on condition that ,is regarded valid to be assigned to the committer ,will lead to the establishment of criminal responsibility and specific penalty as well unless ,the convict is not unruly behavior that most of these deviant&nbsp; treatments&nbsp; are based on mental disorder while , the person is not aware of its existence . the convict commits the crime due to the undeniable influence of mental disorder, without being ever of the consequences of this action the target of this research is investigating on the imposition of criminal responsibility among phsychis patients by probing the garlic punitive legislative of criminal rules and expressing the impacts of certain severe mental illnesses at the time of committing the crime.</p> بیماری روانی؛ جنون؛ ارتکاب جرم؛ مسؤولیت کیفری Psychiatric Patients, Patients, Psychosis, Criminal act, Legal Responsibility 161 186 http://ijmedicallaw.ir/browse.php?a_code=A-10-1-230&slc_lang=fa&sid=1 Zahra Dastan زهرا داستان reyhanedastan@yahoo.com 10031947532846005143 10031947532846005143 Yes دانشگاه آزاد اسلامی واحد تهران شمال و پژوهشگر مرکز تحقیقات اخلاق و حقوق پزشکی، دانشگاه علوم پزشکی شهید بهشی
