fa ماهیت حقوقی رابطه پزشک و بیمار و سبب ایجاد آن <p dir="RTL">نگاهی اجمالی به نوشته‌هایی که از دیدگاه حقوقی به رابطه پزشک و بیمار پرداخته‌اند، نشان می‌دهد که چگونه مسؤولیت پزشک، عمده مباحث را به خود اختصاص داده است. هر گاه نیز که به مرحله پیش ازآن یعنی تعهدات پزشک نسبت به بیمار توجه شده، نگاه‌ها به خود تعهد و موضوع آن که مآلاً به مسؤولیت منتهی می‌شود، متوجه بوده است.</p> <p dir="RTL">در این مقاله سعی می‌شود تا با تکیه بر مبانی حقوقی و فقهی در حقوق قراردادها نشان داده شود که ناگزیریم پیش از طرح مباحث تعهدات پزشک و نقض آن -که احیاناً به مسؤولیت می‌انجامد- به ماهیت حقوقی این رابطه بپردازیم. در تحلیل ماهیت حقوقی یک رابطه، باید آن را از حقوق و تعهدات فرعی آن رابطه بازشناخت. طبیعی است اگر ماهیت حقوقی یا اثر اصلی در یک رابطه که به سببی از اسباب حقوقی ایجاد شده تعهد باشد، می‌توان در تحلیل این رابطه به بررسی تعهدات و حقوق طرفین پرداخت.</p> <p dir="RTL">ولی اعتقاد ما این است که حقوق و تعهدات پزشک و بیمار امری فرعی و مسبوق به وجود ماهیت حقوقی دیگر به نام نیابت است که باید حقیقت این ماهیت و سبب حقوقی ایجاد آن را باز شناخت.</p> <p>A glimpse on the writings that have addressed the relation between the physician and the patient shows that how the physician&rsquo;s responsibility has appropriated most topics. Whenever the stage before it i.e. the physician&rsquo;s obligations towards the patient were noticed, the looks have been focusing on the very obligation and its subject that ultimately leads to the responsibility.</p> <p>In this paper, it is tried to show that we have to deal with the legal nature of the relation before raising the topics on the physician&rsquo;s obligations and their breach relying on the legal and juridical fundamentals in the law of contracts. For analyzing the legal nature of relation, it should be distinguished from the subsidiary law and obligations of that relation. It is natural that if the legal nature or the main implication of a relation that have been created due to legal cause are an obligation, the parties&rsquo; obligations and rights may be discussed in analyzing this relation.
