fa جراحی‌های زیبایی؛ ضرورت یا زیادت؟ قولی در ماهیت تعهدات جراحان زیبایی <p dir="RTL">اگرچه در اکثر نظام‌های حقوقی و حتی در کشورهای اسلامی که بعضاً قوانین آن‌ها برگرفته از فقه عامه است ماهیت تعهدات پزشکی علی‌الاصول تعهد به وسیله معرفی شده است، لکن در برخی موارد خاص و بنابر دلایل معقول و متناسب با ضروریات و نظم نوین حاکم بر جامعه و توجه توأمان به نظم و عدالت، ماهیت تعهدات حرف پزشکی تعهد به نتیجه دانسته شده است. در نظام حقوقی ایران علی‌الظاهر به تبع قول مشهور فقهای امامیه، ماهیت تعهدات پزشکی تعهد به نتیجه معرفی شده است که این امر با این اطلاق قابل انتقاد به نظر می‌رسد، مع‌هذا پذیرش این امر ـ به نتیجه دانستن تعهدات جراحان در جراحی‌های زیبایی غیر ضروری ـ منطقی و منطبق با واقعیات جامعه به نظر می‌رسد. لذا در این مقاله ضمن شرح مختصری از پیشینه موضوع و اقوال موافقان و مخالفان، تلاش شده است ماهیت تعهدات جراحان زیبایی با نگاهی مقارنه‌ای و تطبیقی مورد مطالعه قرار گیرد. به همین منظور به بررسی تحلیلی ماهیت تعهدات جراحان در مصداق متنازع فیه، متداول و مبتلا‌به آن، یعنی جراحی زیبایی ـ اعم از ضروری یا غیرضروری ـ پرداخته شده است.</p> <p>Although in most legal systems and even in Islamic countries whose codes are drawn from Sunni jurisprudence, the nature of medical obligations is the obligation to means, but in some special cases and according justifiable reasons in accordance with the requirements and the new order ruling the society and regarding to a simultaneous attention to the order and justice, the nature of medical obligations is the obligation to results. Apparently in the Iranian&#39;s legal system following the majority of Emamyeh&#39;s jurisprudence, the nature of medical obligations has been introduced as the obligation to results which seems be able to criticized.</p> <p>However the acceptance of this subject -obligation to results of the obligation of the surgeons in unnecessary cosmetic surgeries - seems reasonable, logical and consistent with the realities of the society. So in this article, with a brief description of the history of the subject and the views of proponents and opponents, the nature of medical obligations and their examples it&#39;s been tried to comparatively study.
