fa قابلیت حمایت از ابداعات مهندسی ژنتیک در نظام حقوق مالکیت فکری <p dir="RTL">ابداعات &laquo;مهندسی ژنتیک&raquo; به عنوان &laquo;مال فکری&raquo; در نظام حقوق مالکیت فکری قابل حمایت است. حمایت از بسیاری از این ابداعات در نظام حقوق مالکیت فکری از جهات مختلف اقتصادی، زیست محیطی، اخلاقی و حقوق بشری توجیه‌پذیر است؛ بر اساس مبانی موجود در زمینه هریک از جهات مذکور، برای حمایت از ابداعات مهندسی ژنتیک در نظام حقوق مالکیت فکری، اعمال مهندسی ژنتیک باید با رعایت اصول و مؤلفّه‌های مطلوب اقتصادی، زیست محیطی، اخلاقی و حقوق بشری صورت گیرد. همچنین، بر اساس این مبانی انجام برخی از اعمال مهندسی ژنتیک جایز نیست، در نتیجه نمی‌توان از ابداعات ناشی از این گروه از اعمال مذکوردر نظام حقوق مالکیت فکری حمایت به عمل آورد.</p> <p dir="RTL">مطابق مدلول ماده2 قانون ایمنی زیستی 1388 ش.، انجام اعمال مهندسی ژنتیک در حقوق موضوعه ایران، جایز است. ماده8 قانون مذکور و همچنین بند 2 ماده 16 کنوانسیون تنوّع زیستی، که ایران به آن پیوسته است، ابداعات مهندسی ژنتیک را مشمول نظام حقوق مالکیت فکری می‌دانند.</p> <p>Genetic engineering innovations are protectable in intellectual property law system as intellectual properties. Protection of many of these innovations in economic, environmental, moral and human rights fundamentals is justifiable. Based on existing fundamentals in field of mentioned aspects, protection of genetic engineering innovations is provided to application of economic, environmental, moral and also human rights principles. Also based on these fundamentals doing of some genetic engineering actions is prohibited, so we can&rsquo;t protect innovations which are obtained by these kinds of actions.</p> <p>&nbsp;According to Article 2 of Biosafety Act 1388, doing genetic engineering actions in Iran&rsquo;s regulations is legitimate.
