fa استفاده، انتقال و توسعه تکنولوژی در صنایع بالادستی نفت و گاز ایران پژوهشي Original Article <p dir="RTL">کشور ایران که یکی از اصلی‌ترین دارندگان ذخایر نفت و گاز دنیا است، برای داشتن عملکرد بهتر در سرمایه‌گذاری و انجام پروژه‌های نفتی نیازمند بروزرسانی تجهیزات و توانمندی‌ها و روش‌های انجام پروژه خود توسط شرکت‌های بین‌المللی نفتی می‌باشد تا از این طریق بتواند از بهترین فناوری‌های موجود برای انجام عملیات تحقیق و توسعه استفاده کند یا زمینه انتقال آن‌ها را فراهم آورد.</p> <p dir="RTL">این پژوهش علاوه بر ارائه تعاریف مختصری از مفاهیم استفاده، انتقال و توسعه تکنولوژی، تفاوت این موارد را در عمل و از دید اجرایی بیان می‌کند و مسائل مهمی را که در اجرای پروژه‌های مبتنی بر این قراردادها حادث می‌شود، از نظر می‌گذراند. پس از بررسی موضوعات مهم و اساسی در قراردادهای استفاده، انتقال و توسعه تکنولوژی، <a name="_Ref401610493">بر اساس یافته‌های این پژوهش، موضوعات استفاده، انتقال و توسعه تکنولوژی، دارای ماهیتی متمایز و قابل تفکیک از یکدیگرند و باید به طور جدی توسط شرکت‌های بین‌المللی نفتی در مراحل اکتشاف، توسعه و عملیات میادین ایران مورد توجه قرار گیرد</a>. به علاوه، حقوق و تعهدات مختلف شرکت ملی نفت ایران و شرکت‌های بین‌المللی نفتی در قراردادهای بالادستی کشور در خصوص تکنولوژی، باید به خوبی شناسایی و درک شود. انعقاد این قراردادها باید همراه با ظرافت و هوشمندی باشد و موضوعات اساسی و حیاتی با دقت در آن گنجانده شود<span dir="LTR">.</span></p> <p dir="RTL">همچنین ضمانت اجرایی نیز برای عدم رعایت هر یک از آن‌ها در نظر گرفته شود. سرانجام، به منظور اجرایی‌شدن موضوعات استفاده، انتقال و توسعه تکنولوژی و تأمین منافع ملی در ارتباط با تکنولوژی، باید اذعان داشت که کشورمان نیازمند انعقاد قراردادهایی جامع و مبتنی بر مشارکت کارفرما و پیمانکار، درج شروط هدفمند در کنار تدوین قانونی جامع و ایجاد نهادی نظارتی و حاکم بر تمام قراردادهای نفتی می‌باشد.</p> <p>Islamic Republic of Iran is considered as one of the major holder of oil and gas reserves in the world. In order to obtain the better performance when investing and operating in the oil and gas fields, it is highly requested that an international oil company (&quot;IOC&quot;) should update its hardware, software capabilities and, in particular, project management methods, in order to utilize and transfer the best available technology while getting involved with National Iranian Oil Company (&quot;NIOC&quot;) for the research and development (R&D) of the existing technology. This study attempts to define the concept of utilization, transfer and development of technology in oil and gas upstream projects, and to specify the boundary lines of differences between utilization, transfer and development of technology when carrying out the oil and gas upstream projects. Furthermore, this study shall also highlight the main issues and elements should be considered in the upstream projects.</p> <p>After due considerations given to the issue of utilization, transfer and development technology, this study concludes that first the issue of utilization, transfer and development of technology and know-how should be seriously considered by IOC when exploring, developing and operating Iran oil and gas projects. Secondly, various lines of rights and duties of both IOC and NIOC in the technology issue should be clearly identified, understood and concluded in the concerned Iran upstream contracts.
