fa قابلیت دادخواهی حق بر سلامت در نظام حقوق بین‌الملل مروری Review Article <p dir="RTL">حق بر سلامت یکی از حقوق بنیادین بشر است که در اسناد بین‌المللی متعدد در سطوح جهانی و منطقه‌ای و همچنین در نظام‌های حقوقی ملی مطرح شده است. از ابتدای تدوین اسناد بین‌المللی حقوق بشر، چالش‌هایی در مورد قابلیت دادخواهی حقوق اقتصادی، اجتماعی و فرهنگی که حق بر سلامت یکی از مهم‌ترین اجزای آن است، وجود داشته است. این موضوع به کم‌اهمیت‌انگاشته‌شدن این حقوق از سوی دولت‌ها انجامیده و به عنوان ابزاری برای توجیه تضییع حقوق مردم تبدیل شده است. در این مقاله، قابلیت دادخواهی حق بر سلامت در نظام بین‌الملل، بر اساس مطالعات موجود، اسناد قانونی مرتبط در نظام حقوق بین‌الملل و تفسیرهای ارائه‌شده از سوی مراجع مختلف مورد بررسی قرار گرفته است. نتایج این مقاله بیانگر آن است که حق بر سلامت از نظر ماهیت، حقی قابل دادخواهی است و بارها در دادگاه‌های بین‌المللی، منطقه‌ای و ملی مورد دادخواهی قرار گرفته است. دولت‌ها بایستی برآوردن حداقل نیازهای سلامت افراد را به عنوان یک الزام اجتناب‌ناپذیر در نظر گرفته و همه امکانات اداری، مالی، قانونی و قضایی خود را در این راستا به کار گیرند.</p> <p>Right to health is a fundamental right that has been mentioned in several international and regional documents and national laws. Since the beginning of the codification of human rights documents, there have been some challenges about justisiability of Economic, Social and Cultural rights including the right to health as one of the most important components of these rights. This led to the ignorance of these rights by the governments and the issue turned into a mean for justifying the violation of human rights of people.</p> <p>In this article, justiciability of the right to health in international system was examined by looking to available studies and relevant legal documents in international law system and the related interpretations by different authorities. The results showed that substantially the right to health is a justiciable right that has been litigated many times in international, regional and national courts. Therefore the governments should realize the minimum necessities for health of the individuals as an inevitable obligation and they should use all the necessary means including administrative, legal, financial and judicial ones in this regard.</p> <div> <p>Please cite this article as: Kokabisaghi F.
