fa چالش‌ها و الزامات دولت‌ها در تنظیم مقررات در حوزه سلامت مروری Review Article <p dir="RTL">حق بر سلامت عمومی، جزئی از حقوق بنیادین شهروندان در هر جامعه سیاسی است. هر شهروندی به مثابه عضوی از جامعه صرف نظر از ملاحظات نژادی، دینی، سیاسی و فرهنگی صرفاً به واسطه وجود رابطه شهروندی، دارای حق و استحقاق لازم جهت بهره‌مندی از این حق می‌باشد. این دسته از حقوق، که به طور معمول از آن‌ها در امتداد صیانت و حمایت از حق حیات افراد سخن به میان می‌آید، دارای ارتباط معناداری با دیگر حقوق ابنای بشر می‌باشند. از این رو است که توجه لازم و بایسته به حق بر سلامت عمومی شهروندان از سوی دولت‌ها فارغ از ساختار نظام سیاسی آن‌ها امری ضروری به نظر می‌رسد. تهیه، تدوین و تصویب حجم وسیعی از اسناد و معاهدات بین‌المللی مرتبط با حق بر سلامت عمومی و نیز وضع قوانین و مقررات موضوعه داخلی در این زمینه خود دلیلی بر این مدعا است. با این وجود، پیشینه فعالیت و اقدامات دولت‌ها و نیز اشخاص حقوق عمومی تنظیم‌کننده مقررات سلامت عمومی حاکی از عدم وجود شناخت لازم و جامع از سوی اشخاص و نهادهای مسؤول در حوزه سلامت عمومی و نیز عدم توجه کافی به چالش‌ها و الزامات دولت‌ها در تنظیم مقررات در حوزه سلامت عمومی شهروندان می‌باشد. در این مقاله، ضمن تلاش برای ارائه بررسی حق بر سلامت عمومی شهروندان به مثابه حقی ذیل حقوق شهروندی، کوشش گردیده است تا چالش‌های دولت‌ها در تنظیم مقررات در حوزه سلامت مورد تحلیل قرار گرفته و الزامات لازم‌الرعایه از سوی دولت‌ها در این زمینه بیان گردد.</p> <p>The right to health is a component of citizens&rsquo; fundamental rights in each political society. Citizens as society members, due to their citizenship, have the right and merit to benefit from these rights, regardless of their racial, religious, political and cultural views. These rights, which are generally related to humans&rsquo; right to life, has a meaningful relationship with other kinds of human rights. Accordingly, governments&rsquo; attention to citizens&rsquo; right to health is an important issue regardless of their political structure. Existence of significant number of international legal acts and treaties related to the right to health, as well as countries&rsquo; internal laws and regulations associated with this issue provide proof for this claim. However, the history of activities of governments and Public law entities in regulating laws in the field of health, indicate that individuals and organizations who are responsible for health issues have a lack of essential and comprehensive knowledge of public health and also shows ignorance of governments&rsquo; challenges and requirements to regulate public health.
