fa دیدگاه اخلاقی خرید و فروش خون در اسناد بین‌المللی و نظام‌های حقوقی پژوهشي Original Article <p dir="RTL">خرید و فروش خون به عنوان یکی از راه‌های متداول تهیه خون و فرآورده‌های خونی همواره مخالفین و موافقین خود را داشته است. خصوصیات و ویژگی‌های منحصر به فرد این عضو از بدن در مقایسه با سایر اعضا، توجه به اهداکننده به عنوان یک منبع تجدیدپذیر و دائمی تهیه خون، سهولت انتقال، تأثیرات به سزای پزشکی و کاربرد ویژه این عنصر حیاتی و فرآورده‌های آن در زمینه‌های دارویی، زمینه کالا‌انگاری، خرید و فروش و سوء استفاده از آن را فراهم نموده و صرف‌نظر از مخاطرات ناشی از توزیع خون آلوده، باعث به خطرافتادن ارزش‌های اخلاقی و انسانی از قبیل نوع‌دوستی گردیده و انسان را در ردیف اشیا و اموال قرار داده است. این امر، موجب دخالت سازمان‌های بین‌المللی از طریق صدور بیانیه، اعلامیه، توصیه‌نامه و تصویب قطع‌نامه و به تبع آن، تحول نظام‌های حقوقی در جهت حفظ کرامت و شأن والای انسانی گردید. بررسی این موارد نشان می‌دهد که خرید و فروش خون، باید بدون کالا‌انگاری، همراه با رعایت جانب ضرورت برای نجات جان انسان و با نظارت کامل دولت‌ها و قانونگذاری کامل و بدون ابهام در این زمینه، صورت پذیرد.</p> <p>Buying and selling blood as a common way to provide blood and blood products always have pros and cons. The unique feature of blood with compare to other organs of the body, attention to the blood donors as a permanent and renewable source, ease of transfusion, contributed medical and special applications of this vital element and its products in the fields of pharmaceutical, have led to goods assumption field as well as misuses, and, regardless of the risks of distributing contaminated blood, would jeopardize the moral and human values such as altruism and, put humans as a property. This ends in the intervention of international organizations through making statement, declaration, recommendations and resolutions and consequently, the development of legal systems in order to maintain the dignity and supreme dignity of humans. This study shows that buying and selling blood must be without commodity conception, with respect to being necessary to human life and to monitor the state and the full legislation in this area can be applied.</p> <p>Please cite this article as: Abbasi M, Shafiee H, Pourfathollah AA, Ommi A.
