fa چالش‌های پزشکی و دارویی جهانشمولی نظام حقوق مالکیت فکری <p dir="RTL">جهانشمولی مالکیت فکری در خصوص محصولات پزشکی و دارویی، به این معنا است که در حال حاضر، اختراعات دارویی و پزشکی، فارغ از مرزبندی‌های سیاسی، در هر جا و همه جا، مورد حمایت انحصاری مالکیت صنعتی واقع شوند. در این پژوهش، از اسناد، مطالب و مقالات مرتبط با جهانی‌سازی مالکیت فکری در حوزه دارو و پزشکی مندرج در تارنماها و منابع کتابخانه‌ای، استفاده شده است. این مقاله، تلاشی است در راستای بررسی حقوقی چالش‌های مختلف در حمایت از اختراعات دارویی و روند جهانی‌شدن آن. بنابراین در این تحقیق، بیش از توجه به تقسیمات جغرافیایی، چالش‌های تأثیرگذار و نیز انتقادات وارده به حمایت از اختراعات دارویی ملاحظه شده است. می‌توان گفت در حال حاضر با توجه به چالش‌های حقوقی ایجادشده، فاقد یک نظام جهانشمول و قدرتمند حقوق مالکیت فکری در زمینه پزشکی و دارویی هستیم و در کوتاه‌مدت نیز تحقق چنین نظمی، غیر ممکن به نظر می‌رسد.</p> <p>Intellectual property plays an increasingly vital role in pharmaceutical and medical trade and development. Globalization of intellectual property rights means that pharmaceutical inventions are now protected anywhere and everywhere defying jurisdictional borders. Intellectual property has moved into the mainstream of national economic and developmental planning of pharmaceutical industry. In the recent years, it has also emerged as a central element of multilateral medical relations. It is probably more accurate to portray pharmaceutical and medical inventions as a class of intangible business asset that is usually held by global companies such as pharmaceutical companies performing the (admittedly important) roles in the modern economy of investors, employers, distributors and marketers. By globalization of intellectual property law, Individual pharmacologists are less frequently the ones who own and control the rights. Viewed in isolation, globalization of intellectual property law is a stunning triumph of the pharmaceutical companies in making global IP rules and in enlisting states and international organizations to enforce them.
