fa تعارض اصل حمایت از اختراعات دارویی و حقوق بشر؛ تفسیر حقوقی ماده 27 موافقت‌نامه تریپس پژوهشي Original Article <p dir="RTL">امروزه اختراعات دارویی بخش مهمی از تولیدات صنعتی را به خود اختصاص داده است و شرکت‌های بزرگ سرمایه‌گذاری به این مقوله توجه نشان داده‌اند و خواهان حمایت از این اختراعات در جهت اطمینان برای سرمایه‌گذاری در این حوزه می‌باشند<span dir="LTR">.</span> ضمن این‌که پیشرفت در این حوزه خود منافع بشری در پی دارد، اما حمایت بدون قید و شرط از این اختراعات در تعارض با حق بر سلامتی افراد قرار دارد که از جمله حقوق بنیادین بشر است. بنابراین در سال‌های اخیر حق اختراعات دارویی و تأثیر آن در تحقق حقوق بشر، به یکی از مباحث چالش‌برانگیز موضوع حقوق مالکیت فکری در میان کشورهای در حال توسعه تبدیل شده است. از یکسو کشورهای توسعه‌یافته خواستار گسترش دایره حمایت از اختراعات دارویی هستند و از طرف دیگر کشورهای در حال توسعه معتقدند که حمایت قوی از اختراعات دارویی، بر حق دسترسی بیماران به داروها تأثیر منفی گذاشته است. بنابراین بررسی این مسأله از منظر حقوق بین‌الملل ضرورتی انکارناپذیر است. متعاقب این مسأله، مقاله حاضر تلاش می‌نماید با بررسی و تفسیر حقوقی و به طور خاص با تفسیر ماده 27 موافقت‌نامه تریپس در رویه قضایی سازمان تجارت جهانی، چالش میان حق اختراع دارویی و حقوق بشر را مورد بررسی و تبیین قرار دهد.</p> <p>Today, pharmaceutical patents constitute an important part of industrial production and investment corporations have shown interest in this issue which is willing to protect these patents for assurance of investment in this area. While progress in this field has human interests, but the unconditional protection of such patents is in conflict with the right to health as one of the fundamental human rights. Therefore, in recent years, drug patents and their impact on the realization of human rights have become one of the challenging issues of intellectual property rights among developing countries. On the one hand, the developed countries want to expand the protection to pharmaceutical patent and on the other hand, developing countries believe that the powerful protection of pharmaceutical patent has have a negative impact on patients&#39; access to medicines. Therefore, it is necessary to discuss this issue from the perspective of international law.
