fa مفهوم و جایگاه حق تأمین اجتماعی در اسناد بین‌المللی پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma;"><span dir="RTL">تأمین اجتماعی به عنوان یک پدیده تاریخی واجتماعی حاصل فرآیند تحولات اقتصادی و اجتماعی جوامع، به ویژه جوامع پیشرفته صنعتی محسوب می‌شود که حسب ضرورت نیاز افراد انسانی به امنیت در مقابل مخاطرات اجتماعی مطرح گردید، ولی هنجارمندی حقوقی آن در قالب یک حق بشری مرهون توجه جامعه بین‌الملل با استناد به صدور اسناد و مقررات بین‌المللی می‌باشد که در این اسناد، حق برخورداری از تأمین اجتماعی با گستره موضوعی متنوع آن به عنوان یک حق اساسی و بنیادی به منظور حفظ کرامت ذاتی بشر و تأمین منافع آن در زندگی فردی و اجتماعی مورد شناسایی واقع شده است که در مقابل دولت‌ها نیز وظیفه اجرای تحقق این حق را عهده‌دار می‌باشند، هرچند دولت‌ها در اجرای این حق، فراخور امکانات و منابع مالی و سایر شرایط سیاسی و اجتماعی به طور یکسان عمل نمی‌نمایند، ولی آنچه مهم است این می‌باشد که حق برخورداری از تأمین اجتماعی مورد شناسایی و پذیرش بین‌المللی و ملی قرار گرفته و از حقوق مکتسب انسان‌ها محسوب می‌شود که اجرای آن از سوی دولت‌ها می‌‌تواند آن‌ها را در برقراری عدالت و امنیت اجتماعی و اقتصادی یاری دهد و شاخص مناسبی برای حفظ صلح و امنیت بین‌المللی باشد. از این رو این مقاله درصدد پاسخ به سؤالاتی از قبیل این‌که حق بر تأمین اجتماعی چه جایگاهی در نظام بین‌المللی حقوق بشر دارد؟ ارکان و مفهوم محتوایی این حق چیست؟ و انواع تعهد دولت‌ها در قبال این حق چه می‌باشد؟</span></span></span></div> <div style="text-align: justify;">Social security as a social and historical phenomenon, is being considered as the result of economic and social development process especially in developing industrial societies proposed as the individual security requirements against the social risks but its legal norms in the human right framework needs international community attention on the basis of issuing international documents, rules and regulations. In the documents, the social security right with all subject varieties is being recognized as the fundamental right to preserve human inherent dignity and supply its social and individual benefits indicating governments are in charge of human right fulfillment. Although all governments regarding, facilities financial resources and other political social conditions, do not fulfill all rights as the same, the right to social security as a fundamental right of every individual is being accepted nationally and internationally which assists governments to do justice and establish social security as well. The right to social security is also regarded as an appropriate indicator in international peace and security preservation. This paper seeks to answer the following questions,What is the position of social security on international system of human rights? What are the social security rights&rsquo; components and concepts?
