فناوری ویرایش ژن کریسپر ـ کَس 9 از منظر حقوق مالکیت فکری و ایمنی زیستی

<div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family: tahoma;">در چند سال اخیر، فناوریهای کمهزینه و مفید ویرایش ژن مانند کریسپر ـ کَس 9 (<span dir="LTR">CRISPR-Cas 9</span>) و <span dir="LTR">NgAgo</span> توانستند در حوزه زیستفناوری تحولات خارقالعادهای را ایجاد کنند. موجود زنده ویراسته ژنتیکی، درمان اختلالات ژنتیکی و بیماریهایی چون ایدز و ویرایش سلولهای انسان تنها بخشی از کاربردهای شگفتانگیز این فناوریها هستند، لیکن بهرهبرداری از دستاورد فناوریهای مذکور در خارج از محیط آزمایشگاهی و پژوهشی و دریافت حقوق انحصاری برای فرآوردهها یا روش استفاده از آنها در سلول موجودات زنده، قابلیت به چالشکشاندن مبانی و قواعد ایمنی زیستی از یکسو و شروط نظام اختراعات را نیز از سوی دیگر دارا می باشد. هدف از نگارش مقاله حاضر، بررسی این دو بُعد بسیار مهم کریسپر ـ کَس 9 با تکیه بر مطالعات تطبیقی و تحلیلی اسناد بینالمللی، رویه مراجع ذیصلاح در اتحادیه اروپا، آمریکا و قوانین موضوعه ایران است. در بخش اول، از منظر ایمنی زیستی مترصد پاسخ به این پرسش هستیم که آیا فرآوردههای حاصل از ویرایش کریسپر ـ کَس 9، تراریخته (<span dir="LTR">GMO</span>) محسوب میشوند؟ به عبارت دیگر آیا «موجود زنده ویراسته ژنتیکی» همان «موجود زنده تغییر شکلیافته ژنتیکی/ تراریخته» میباشد؟ پاسخ به این سؤال میتواند متناسب با رویکردهای فنی ـ حقوقی ذیربط متخذه تبیینگر قابلیت/ عدم قابلیت اعمال مقررات ایمنی زیستی حاکم بر فرآوردههای تراریخته بر فرآوردههای حاصل از کریسپر ـ کَس 9 باشد. در بخش دوم، از بُعد مالکیت فکری به مهمترین چالشهای فراروی ثبت اختراع فناوری کرسپر ـ کَس 9، یعنی احراز شرط گام ابتکاری،کفایت افشا و اخلاق حسنه و نظم عمومی میپردازیم. در نهایت با عنایت به بررسی و مطالعات تطبیقی انجامیافته در دو بخش یادشده، چنین نتیجهگیری میشود که عدم لحاظ مفهوم و ماهیت فنی متمایز دو فناوری «ویرایش ژن» و «تراریختگی» و تلاش صرف جهت انطباق شکلی و یا لغوی هر دو اصطلاح به ویژه از طریق پروتکل ایمنی زیستی کارتاهنا و عدم لحاظ شروط رسمی تفسیر معاهدات مندرج در پاراگراف دوم ماده 31 کنوانسیون وین 1969 نتیجه مطلوبی را دربر نخواهد داشت. مضافاً بر این، حمایت از هر اختراعی تحت نظام ثبت اختراع نیازمند تطبیق توامان ماهیت فنی و حقوقی آن اختراع با شروط حمایتی این نظام میباشد و فناوری کریسپر ـ کَس 9 نیز از این قاعده کلی مستثنی نیست، لذا <a name="OLE_LINK23"></a><a name="OLE_LINK22">آنچه که به طریق اولی میتواند به توسعه و تسریع ضابطهمندی صحیح از منظر ایمنی زیستی از یکسو و حمایت حقوقی مؤثر از این فناوری از سوی دیگر بیانجامد، توسعه دکترین است.</a></span></span></div>
<div style="text-align: justify;">In recent years, inexpensive and fruitful gene editing techniques such as CRISPR-Cas9 and NaAgo have revolutionized the biotechnology industry. Genetically edited organisms, gene therapy, treatment of diseases such as AIDS and editing human cells are <a name="OLE_LINK19">some of the marvelous applications </a>of such technologies. <a name="OLE_LINK14"></a><a name="OLE_LINK13">Using such </a><a name="OLE_LINK16"></a><a name="OLE_LINK15">technologies in large scale </a>or <a name="OLE_LINK18"></a><a name="OLE_LINK17">granting exclusive rights on their products </a>or their application in living organisms might challenge biosafety regulations and patent system principles. The aim of the present article is to analyze the two crucial aspects of CRISPR-Cas9 through a comparative analytical study of the relevant international documents, the procedures of the competent authorities in EU, US and current Iran’s regulations. From biosafety point of view, the main question that we intend to respond is whether gene-edited products can be considered as GMOs or not? The response to this question considering <a name="OLE_LINK29"></a><a name="OLE_LINK28">both legal and technical aspects</a>, will determine applicability of the biosafety regulations governing GMOs on the products resulted from CRISPR-Cas9. From intellectual property angle, we discuss the most important challenges with respect to patenting inventions based on CRISPR-Cas9 including inventive step, sufficiency of disclosure, ordre public and morality requirements. At the end, we conclude that trying to match "Gene-Editing Technology" with "Genetic Engineering" through different interpretations of the Cartagena biosafety protocol without considering the <em>Article 31</em> of the <em>Vienna Conventions</em> on the Law of Treaties (VCLT) which offers clear guidance for the <em>interpretation</em> of treaties also without considering the technical nature of such technologies will have undesirable outcomes. Meanwhile, protecting the Gene Editing Technologies under patent system involves passing patentability requirements and CRISPR-Cas9 based inventions <a name="OLE_LINK27"></a><a name="OLE_LINK26">are not excluded from this rule. </a>Therefore, what can be effective in development and appropriate regulating of such technologies from biosafety point of view, also in legal protection of these technologies is indeed development of doctrines.<br>
