fa بررسی فرآیند حمایت حقوقی از اطلاعات بالینی و آزمایشگاهی داروها در حقوق ایران، اتحادیه اروپا و ایالات متحده آمریکا پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:11px;"><span style="font-family: tahoma;">از مهم‌ترین مصادیق نوین اموال فکری که تشتت آرا در مورد حمایت یا عدم حمایت از آن فراوان است. اطلاعات آزمایشگاهی داروهای جدیدی هستند که به مقامات صالح دولتی برای بررسی و ثبت تقدیم می‌گردند، لذا همواره با این سؤال اساسی مواجه هستیم که حمایت از اطلاعات آزمایشگاهی داروها در چه قالبی صورت می‌گیرد. هدف اصلی نظام حقوقی مالکیت <span style="letter-spacing: -0.1pt;">فکری حمایت از تمام اموالی است که به هر نحوی برگرفته از تراوش‌های ذهنی انسان‌ها</span> می‌باشد. اطلاعات آزمایشگاهی داروها یا همان اطلاعات راجع به کیفیت، امنیت و کارایی داروها دسته‌ای از اموال فکری نوینی هستند که حمایت از آن‌ها در چند دهه اخیر مورد توجه اندیشمندان حقوق قرار گرفته است. این دسته اموال فکری اطلاعاتی ارزشمند هستند که حاصل تلاش‌های شبانه‌روزی متخصصین حوزه داروسازی در آزمایشگاه‌ها می‌باشند و به دست مقامات صالحه ثبتی سپرده می‌شوند تا پس از احراز کیفیت، امنیت و کارایی آن‌ها مجوز تولید و بازاریابی را به دست آورند، اگرچه راجع به اصل حمایت از این اطلاعات اختلاف نظر وجود دارد، اما نظریه غالب و پذیرفته‌شده حمایت از این دسته اموال فکری جدید می‌باشد. با این حال کسانی که <span style="letter-spacing: -0.1pt;">اصل حمایت را پذیرفته‌اند، دیدگاه‌های متفاوتی راجع به نوع نظام حمایتی حاکم بر اطلاعات</span> آزمایشگاهی داروها دارند. برخی نظام اسرار تجاری، برخی دیگر نظام رقابت‌های نامشروع و عده‌ای هم نظام حمایتی ویژه را پذیرفته‌اند. با این حال مقاله حاضر اعتقاد به حمایت از این دسته اطلاعات در قالب نظا م حمایتی ویژه دارد.</span></span></div> <div style="text-align: justify;">One of the most important new evidence of intellectual property that had always plenty of differences behind it regarding the protection or non-protection is the new medicine laboratory information that is presented to the competent state authority for consideration and registry. The original purpose of intellectual property is to protect all property that derives from human intellectual leaking. The medicine laboratory information or the same information concerning the quality, security and effectiveness of medicines is a new intellectual property group that whose protection in recent decades has been considered by the legal scholars. This group of Intellectual property is the valuable information that is the result of round the clock efforts of pharmacy area specialists in the laboratories and are deposited in the hands of registration authority until after obtaining the quality, security and effectiveness to acquire marketing and production. Although there are differences regarding the principle of protection of this information, but the prevailing and accepted view is to protect these new intellectual properties. However, those who accepted the principle of protection have different views on the type of applicable protection system to laboratory information. Some accepted the system of trade secrets, some accepted the system of illegal competition and some others accepted the special protection system.
