fa مبانی مسؤولیت کیفری پزشک در جرائم غیر عمدی در حقوق ایران و انگلستان پژوهشي Original Article <div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:Tahoma;"><span dir="RTL"><span style="color:black;">پزشکان در تمام دنیا وظیفه مراقبت، بهبود و مداوای بیماران را بر عهده دارند، اما گاه در اثرعدم مراقبت یا بی‌احتیاطی پزشکان صدمات فراوانی به بیماران وارد می‌شود که علاوه بر جنبه حقوقی قضیه که منجر به پرداخت خسارات هنگفت می‌شود، سبب ایجاد مسؤولیت کیفری یا انتظامی پزشکان نیز می‌گردد. اصولاً حقوق کیفری به </span></span><span dir="RTL"><span style="color:black;">دلیل</span></span> <span dir="RTL"><span style="color:black;">اصل عمدی‌بودن جرائم در مورد خطاها مداخله نمی‌کند، چون خظا به اعتبار غیر عمدی‌بودن از شمول احکام حقوق کیفری خارج است و حقوق کیفری تنها در موارد بسیار نادر و مهم مانند حمایت از تمامیت جسمانی افراد خود را مجاز به دخالت در مورد اعمال غیر عمدی می‌داند. مسامحه و خطا جز در موارد استثنایی نباید داخل در حوزه حقوق کیفری شود، چنانچه رفتار غیر عمدی در قانون جرم شناخته نشده باشد، اصولاً باید رفتار پزشک را از شمول حقوق کیفری خارج دانست. با این </span></span><span dir="RTL"><span style="color:black;">وجود</span></span> <span dir="RTL"><span style="color:black;">نظام حقوقی ایران چنین اقداماتی را در دسته جرائم غیر عمد و در صلاحیت مراجع کیفری طبقه‌بندی کرده است. در نظام حقوقی انگلستان نیز حتی در فرض عدم پیش‌بینی مجازات برای رفتار ارتکابی غیر عمدی که ایراد صدمه بدنی را به دنبال داشته باشد، مرجع کیفری صالح به رسیدگی است. اعمال زیان بار ارتکابی توسط پزشک همانند سقط جنین فقط در صورتی جرم هستند که عمدا</span></span><span dir="RTL"><span style="color:black;">ً</span></span> <span dir="RTL"><span style="color:black;">ارتکاب یافته باشند، جز در مورد تقصیر منتهی به مرگ از ناحیه پزشک که قانونگذار در هر حال آن را مستوجب حبس اعلام کرده است. تحقق جرم غیر عمدی منوط به احراز تقصیر مرتکب است که شامل عدم رعایت موازین علمی و عملی می‌شود. یافته‌های تحقیق نشان می‌دهد هر دو نظام حقوقی ضمانت اجرای کیفری را در صورتی قابل اعمال می‌دانند که پزشک مرتکب تقصیر فاحش شده باشد.</span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:12px;">Physicians all over the world are responsible for the care, recovery and treatment of patients, but sometimes as a result of inadequate care or negligence of Physicians, there is a great deal of damage to patients, which in addition to the legal aspect of the case that results in substantial damages, can result in criminal or police liability of physicians. In principle, criminal law does not interfere with errors because of the deliberate nature of the crimes. Because it is unjustifiably excluded from the scope of criminal law, criminal law only permits its individuals to intervene in unintentional acts, only in very rare and important cases, such as the protection of their physical integrity. Neglect and error, except in exceptional cases, should not fall within the scope of criminal law. If unintentional behavior is not recognized in criminal law, physician behavior should be excluded from criminal law. However, the Iranian legal system has classified such actions as unintentional offenses and within the jurisdiction of criminal authorities. Even in the British legal system, a competent criminal authority is under consideration even for the presumption that the punishment for unintentional misconduct would result in physical harm. Harmful acts committed by a physician such as abortion are only a crime if they are deliberately committed, except in the event of death by the physician, which the legislator has in any case mandated imprisonment to commit unintentional crime. It is the fault of the perpetrator that involves not following scientific and practical standards.
