<div style="text-align: justify;"><span style="font-size:12px;"><span style="font-family:tahoma;">دولت در مقام تأمین بهداشت عمومی و رفع نیازهای پزشکی و درمانی از طریق سازمان انتقال خون ایران و با نظارت وزارت بهداشت، درمان و آموزش پزشکی مبادرت به تولید و توزیع خون و فرآوردههای خونی مینماید. طرح دعاوی متعدد جبران خسارت خونهای آلوده، سازمان را بر آن داشته که با توسل به ماده 11 قانون مسؤولیت مدنی مصوب 1339، مدعی معافیت از جبران خسارت ناشی از انتقال خون در اعمال حاکمیت دولت گردد. این حقیقت که عملکرد مراجع دولتی در تأمین خون جزء کدام یک از اعمال حاکمیت یا تصدی دولت است، محل مناقشه است و نقش به سزایی در فراز پایانی ماده قانونی موصوف به عنوان استثنای جبران زیان ناشی از انتقال خون دارد.<br>
در مقاله حاضر تلاش شده <a name="_Hlk490928102">با ارائه تفسیری صحیح از ماده 11 قانون مسؤولیت مدنی</a> و با توجه به میثاق بینالمللی حقوق مدنی و سیاسی 1354، قانون مدیریت خدمات کشوری 1386، قانون آیین دادرسی کیفری 1393، منشور حقوق شهروندی 1395، قانون اساسی و آرای محاکم قضائی لزوم جبران زیان ناشی از اعمال سازمان انتقال خون و وزارت بهداشت، درمان و آموزش پزشکی مورد مطالعه قرار گیرد.</span></span></div>
The government is engaged in producing and distributing of blood and blood products as a part of public health, medical and therapeutic needs through the Iranian blood transfusion organization which works under supervision of ministry of <a name="_Hlk491217239">health and medical education</a>. The multiple lawsuits of compensating blood infections have prompted the organization, to claim exemption from compensation of blood transfusion in sovereignty action by resorting to article 11 of civil liability act 1960. The fact that the government's function in supplying blood as one of the sovereignty or enterprise action, is a controversial issue and has a significant role in ending described law as an exception to the compensation for damage of blood transfusion.<span dir="RTL"></span><br>
The present paper attempts to provide an accurate interpretation of article 11 of civil liability act 1960 and according with the international covenant civil and political rights1966, national service management act 2007, criminal procedure act 2014, charter of citizen's rights 2016, constitution law and judiciary decision, studies the necessity of compensation of blood caused by activities of blood transfusion organization and ministry of health and medical education.<span dir="RTL"></span><br>
