fa تحلیل مبانی حقوقی قرارداد پزشک و بیمار <p>بررسی توافقی که بین بیمار و پزشک جهت برخورداری بیمار از خدمات فنی پزشک به عمل می‌آید، آغاز تحلیل‌های حقوقی رابطه پزشک و بیمار است؛ هرچند قرارداد تنها سبب ایجاد رابطه حقوقی نیست، اما قراردادی که متضمن اذن بیمار است، هم تقدم رتبی و ارزشی و هم شیاع بیشتری نسبت به اذن قانونی دارد. تعیین نوع قرارداد نه تنها خود اصالت و ارزش ذاتی در مباحث نظری حقوقی دارد، بلکه از حیث تبیین اوصاف (احکام)، شرایط انعقاد و تشخیص آثار اهمیت فراوان دارد. اگر اراده انسان مهمترین سبب ایجاد ماهیت‌ها و آثار حقوقی است، این اراده باید در قالبی قرار گیرد که مورد شناسایی قانون قرار گرفته باشد. هر تلاشی برای تبیین نوع قرارداد، تلاشی است برای شناسایی قالب حقوقی که تحلیل شرایط و آثار را نظم می‌بخشد. حال این قالب می‌تواند معین یا نامعین باشد، ولی به هر حال اوصاف قرارداد و شرایط صحت آن با تحلیلی که از ماهیت عقد می‌شود، متفاوت خواهد بود.</p> <p>Examination of the agreement between the patient and the physician for the benefit of the patient from medical services of the physician is the outset of legal analyses of their relation. Determining the type of contract has not only authenticity and intrinsic value in legal theoretical discussions but also a great importance in respect of explaining attributes (rules), conditions of conclusion and the identification of consequences. If the human will is the most important cause for the creation of legal entities and consequences, it must be placed within a frame recognized by the law. Any attempt for the explanation of the contract&rsquo;s type is an attempt for the recognition of a legal frame that regulates the analysis of the conditions and consequences.
