مرگ مغزی؛ نه مرگ قطعی و نه حیات؛ وضعیتی خاص در پرتو تکنولوژیهای نوین زیستپزشکی
Brain Death not certain death and not life special condition in light of Modern Biomedical Technologies
<p>با شناخت و تبیین پدیده مرگ مغزی به کمک تکنولوژیهای نوین زیست پزشکی در نیم قرن اخیر، چالشی جدی فراروی علمای علوم مختلفی چون پزشکی، فلسفه، اخلاق، حقوق و نیز مراجع دینی در ارتباط با شرایط و مصادیق تحقق مرگ قطعی مطرح گردیده است که به نظر میرسد با گذشت دهها سال این اختلافات کماکان ادامه دارد تا آن جا که دو گروه عمده در مقابل یکدیگر قرار داده شدهاند: کسانی که مرگ مغزی را به مثابه مرگ قطعی میدانند و کسانی که مرگ مغزی را دستکم به واسطه ادامه جریان خون و حیات قلبی ـ تنفسی، قسمی از حیات میپندارند. به نظر میرسد با درک ماهیت حقیقی مرگ مغزی و جهت ترتب آثار مناسب در تمامی جهات اقتصادی، اجتماعی و فقهی- حقوقی بایستی اذعان نمود که مرگ مغزی نه مرگ کامل و قطعی است و نه حیات؛ بلکه میتوان آن را پدیدهای نوظهور در سایه تکنولوژیهای نوین زیستپزشکی دانست که مبین وضعیتی خاص بوده و فلسفه وجودی آن در نظام هدفمند خلقت، پاسخگویی به نیاز بیماران محتاج به اعضای پیوندی میباشد. با بهرهگیری از این تئوری و شناساندن آن به افراد جامعه در قالب فرهنگیسازی مستمر، بایستی جایگاه اهدای اعضای مبتلایان به مرگ مغزی به یک اصل اخلاقی پذیرفته شده در جامعه ارتقا یابد</p>
<p>With the cognition and analysis of the phenomena of brain death through the modern bioethics technologies during the past 50 years, scientists of medicine, philosophy, ethics, law and religious clerics have all faced a new challenge as to the conditions and subjects of such death and it seems despite passage of decades, discrepancies still go on so that two main groups are facing each other. Those who regard the brain death as conclusive death and those who regard it as a part of life due to the continuation of blood circulation and heart and breath livelihood. With comprehension of brain death and its consequences in all economic, social, legal and theological aspects, It seems that brain death is neither a conclusive and complete death and nor life. Rather we may analyze it as a newly emerged phenomena under the modern bioethics technologies that defines a particular status and its "reson d' etra" in the purposeful system of creation is to accommodate the requirements of patients in need of organ transplantation. Benefiting from this theory and making it known to the members of the society within sustained cuture-making methods, organ donation of brain death patients should be promoted into an accepted ethical principle in the society.</p>
