Abstract:
Background and Aim: Infectious diseases during pregnancy that may lead to maternal hyperthermia can leave adverse effects not only on the pregnant mother, but also on her fetus and overshadow the health of the fetus. Several factors including social factors, economic factors and environmental factors are effective in the occurrence of hyperthermia in the mother. The basic challenge is how the origin of hyperthermia is revealed in terms of crime and pseudo-crime. There is a deep relationship between the origin of this event and the real and legal responsibility for it. The purpose of the discussion is to evaluate the legal and moral responsibility of the government and the individual towards hyperthermia and to express its harmful effects on the fetus from the perspective of embryology.
Method: The present research evaluates the origin of hyperthermia and the responsibility of natural and legal persons for its occurrence, which will affect the fetus with the use of descriptive-analytical method and library studies.
Ethical Considerations: This research has been carried out in compliance with ethical and trustworthy principles.
Results: The findings indicate that social, economic and environmental factors play a significant role in infectious diseases and hyperthermia in pregnant women. Medical studies in the direction of maternal hyperthermia have reported many defects in the growth and development of the fetus. The origin of hyperthermia is reflected in the criminal dimension towards the real mother and the negated contractual mother, in the dimension of guilt towards both of them and in the dimension of negligence towards the legal entities. The responsibility of the government regarding the occurrence of hyperthermia caused by infectious diseases and the lack of proper treatment is reflected in two aspects: Legal and moral responsibility for social support of the pregnant mother and legal and moral responsibility of the mother for the health of the fetus.
Conclusion: The occurrence of hyperthermia in pregnant women and its harmful effects on the fetus are considered a quasi-crime.
