Abstract:
Background and Aim: One of the most important legal strategies in the management of infectious diseases is to predict differential criminal responsibility for doctors in this regard along with the requirements related to it.
Method: The mentioned article is descriptive and analytical and the library method was used.
Ethical Considerations: In all stages of writing the present research, the originality of the texts, honesty and trustworthiness have been observed.
Results: The findings of the research show that there is no special law regarding the criminal responsibility of doctors for infectious diseases and it is necessary to refer to the general rules and possibly scattered legal articles in this regard. Accordingly, it is necessary to prepare a national document related to infectious diseases. Eliminating the legal gap in order to identify the differential criminal responsibility of the doctor for infectious diseases and verifying the causal relationship in particular, are the most important requirements for preparing a national document related to these diseases.
Conclusion: The current approach of the criminal system is the lack of a national document for the treatment of infectious diseases and the lack of differential criminal proceedings for doctors against infectious diseases, which is in complete conflict with the requirements under discussion.
