Abstract:  
Background and Aim: Children born from white marriages (unregistered unions), due to the lack of legal identity and unregistered births, are deprived of fundamental rights such as healthcare services and insurance. Iran, by acceding to the Convention on the Rights of the Child (CRC, 1989) with the condition of compliance with Islamic principles, has committed to protecting children. However, domestic laws lack specific mechanisms for these children. How can Iran, by utilizing comparative approaches in international child rights law, strengthen medical rights policies for children born from white marriages? This study compares Iran’s legal gaps in birth registration and access to healthcare services with its obligations under the CRC and the experiences of Islamic countries.
Method: Using an analytical-comparative method, the study examines Iran’s laws in contrast to CRC obligations and practices in Islamic countries.
Ethical Considerations: Throughout the research process, authenticity, honesty and integrity in referencing sources have been observed.
Results: The absence of legal identity deprives children of white marriages of healthcare and social services. Reforming civil registration laws, developing non-discriminatory insurance policies and formulating medical policies based on the CRC - while adhering to Islamic principles - can be effective. Models from Islamic countries such as Indonesia (establishing lineage through DNA testing) and Malaysia (facilitating birth registration by mothers) can be instructive.
Conclusion: Children from white marriages in Iran are deprived of Health services due to their lack of legal identity. Inter-institutional coordination and strengthening the role of civil society organizations, alongside legal reforms based on international and Islamic experiences, can address these gaps. Such measures, aligned with Iran’s obligations and Islamic values, will help guarantee children’s rights, reduce inequalities and improve public health.
