Abstract:  
Nowadays, biotechnology is one of the most important technologies of the century in various arenas of health, agriculture, animal husbandry, environment, industry and mining, military and defence affairs, genetic engineering, Due to this effective presence, every society should determine its fundamental position towards moral and legal problems resulting from sciences and technologies such as fundamental cells, nano, human cloning, genetic engineering, transgenic, etc.
As for biotechnology pattern one of advanced and vast knowledges bring commitment of various offences that damaging effects is high dangerous. Thus determination of deterrent punishments for exploiters from biological technologis is inevitable necessity.
Criminal aspects of protect from biotechnology subjects are among issues raised in the intraction between Criminal law and biotechnology. Among the accepted principles of criminalization, the principles of loss, legal patriarchy and legal ethicism that can be criminalized based them. The study of proper Criminal answers to these crimes could be also important in addition to the criminalization in this field.
In the international arena, efforts have been made to regulate biotechnology activities with the use of criminal law tools. The emergence and appearanceof it in the adoption of various international documents and declarations can be observed and in the legal system of Iran laws related to biotechnology include laws such as the biosafety Code, the law on the Registration of Plant Varieties, and the Certificate on Seed and Plant Seedings and the Low on the Modification of Materials from the Smuggling of Goods and Currency Act and the Biological Protection Act and the Plant Variety Act in the legal system of England, whiche can be found in each of these laws has been protected by some of the technology- based biotechnology. In this study, while clarifying the criminal offences in these laws and penalties.
