Abstract:  
Background and Aim: The family as a living body has different components that men and women are the main members of this body and each of them, by playing their own role, provides the background for the health and dynamism of the society Wise differences in the roles and activities of men and women guarantee the harmony and dynamism of the collection and prevent the occurrence of disorders in this single body At the same time, the creation of dynamic societies and complete human beings is also in the group of coordination and reciprocity of members especially the relations between men and women in the family center. For family laws, due to the special importance of the subject, special laws have been set. In this research, the study of the rights to the physical and mental health of the fetus under the banner of family rights; In the legislative texts of Iran will be the main purpose.
 
Materials and Methods: This research has been compiled using library resources in an analytical-descriptive manner.
 
Results: The findings show that most people do not know the rules and regulations related to the fetus. In fact, the provisions related to the fetus are also in the margins of the books.
 
Ethical considerations: In this research, from the beginning to the end, the principle of fidelity and honesty has been prepared and compiled.
 
Conclusion: The family as a living body has different components that men and women are the main members of this body and each of them, by playing their own role, provides the background for the health and dynamism of the society. Wise differences in the roles and activities of men and women guarantee the harmony and dynamism of the collection and prevent the occurrence of disorders in this single body. For family laws, due to the special importance of the subject, special laws have been set. the study of the rights to the physical and mental health of the fetus under the banner of family rights; In the legislative texts of Iran will be the main purpose. It should be said that due to the many issues related to public and private rights of individuals after birth and related rulings, caused. Rulings related to the fetus should be marginalized in jurisprudence books and people with the most basic rights that God has for human beings in the stage He predisposes them to be ignorant before birth, so according to the Holy Qur'an, before birth in the embryonic period, man goes through several stages of development to be worthy of receiving the human soul, then after obtaining the necessary existential possibilities to continue living with the will. God is born The results show that after the fertilization of the embryo, his first right is the right to life. As I mentioned, Islamic law and the law in question emphasied it. But the right to life alone is not the main purpose, and the fetus has the right to have a good life in the mother's womb and to be provided with physical and mental health.
