Abstract:
Background and Aim: The changes in today's world and the emergence of new challenges, including in the field of physical and mental health, require that human rights be changed in accordance with these developments. The outbreak of Covid-19 is a new dangerous situation that has had a profound impact on the relationships between couples and families. One of the negative effects of this disease is on the sexual relations of couples. Therefore, the purpose of the research is to investigate the effect of the disease of Covid-19 on the increase of the anxiety of the disease in the wife and her avoidance of sexual relations with the husband (disobedience) due to the fear of contracting the disease, as well as to investigate the legal aspects of this issue and to present the unity of the judicial procedure. In dealing with those who refer to judicial authorities due to lack of compliance, it is due to the anxiety of the disease.
Methods: The mentioned article is descriptive and analytical and library method is used.
Ethical Considerations: In all stages of writing the present research, the originality of the texts, honesty and trustworthiness have been observed.
Results: It showed that the covid-19 disease not only leads to an increase in marital conflicts, but due to the anxiety disorder of the disease, it can lead to a reduction or complete avoidance of sexual relations by couples.
Conclusion: Considering the dynamic nature of the legislation, it is concluded that it is better if the psychological and psychiatric experts diagnose the anxiety of the disease in the wife, the primary rule of compliance should be dropped and the secondary rule of non compliance should be replaced.
