Abstract:
Background and Aim: In the new developments of human societies, the right to communication is considered as the fourth generation of human rights, a new discourse and a new idea in the information age. The importance of this generation of human rights is as much as the experts emphasize that today it is not possible to realize important rights such as the right to life or the right to self-determination without the right to communication. Considering the emergence of new means of mass communication in the current world and the tendency of the doctrine of human rights of advanced countries to realize the human rights of this generation. In the Constitution of the Islamic Republic of Iran, the right to free access to information is not specified.
Method: The present research was carried out using a descriptive - analytical method.
Ethical Considerations: In the present research, the principles of trustworthiness, honesty, impartiality and originality of the work have been observed.
Results: With the expanded interpretation of the twenty-fifth article of the constitution, as well as the eighth article of this law, it may be possible to partially guarantee the right to access information. The right to access to information is one of the fundamental principles of democratic governments and one of the important examples of the first generation of human rights and guarantees the rights of citizens.
Conclusion: In the constitutional laws of the Islamic Republic of Iran, various principles of the constitution have implicitly emphasized the necessity of freedom of information.
