Abstract:
Background and Aim: Violence against women has been investigated in numerous research works, but what can be important is the comparative investigation of this crime in jurisprudence and international law, the purpose of this article is to examine violence against women's health from the perspective of Iranian jurisprudence and law and international human rights documents.
Method: The mentioned article is descriptive and analytical and library method is used.
Ethical Considerations: In all stages of writing the present research, the originality of the texts, honesty and trustworthiness have been observed.
Results: Violence against women's health includes a range of types of violence against women's physical and mental health. Violence against women's health includes physical violence such as beating, breaking mental and psychological violence such as female circumcision and rape. Jurisprudence, Iranian law and human rights documents do not have the same approach regarding all these examples of violence and according to the case, they have reacted to Ibn Nuha's violence.
Conclusion: The approach of Iranian jurisprudence and law towards all types of violence against women's health overlaps with human rights documents in some cases and differs in some cases. For example, according to some jurisprudential views, it is permissible for a husband to beat a wife as long as it does not cause harm to the wife, but in Iranian law and international human rights documents, such a right is not accepted for the husband.
