Abstract:
Background and Aim: Bodily injuries caused by medical accidents are one of the important issues affecting society, and compensation for the resulting damage needs to be discussed and investigated. Based on this, the aim of this article is the legal analysis of compensation for physical injuries caused by medical accidents.
Method: Using descriptive and analytical methods and employing library-based data collection methods.
Ethical Considerations: In all stages of writing the present research, the originality of the texts, honesty and trustworthiness have been respected.
Results: Some comprehensive compensation systems cover all types of accidents and, of course, all medical injuries, while others cover only the losses specified in the law, and their range includes medical accidents, while some impose certain limiting conditions and for example only the victims of severe and rare medical accidents are protected. In Iran's legal system, there is no special forensic medicine regarding medical and liability, and courts issue judgments based on general, civil, civil and criminal liability laws.
Conclusion: Considering the increasing number of victims of medical accidents and the lack of legal enamel necessary to compensate them, it is necessary to make a change in the civil liability law system of Iran, which will achieve the goal of protecting the victims and compensating them unconditionally in the best possible way; Therefore, it is necessary to establish a special compensation system in the field of medical losses.
